Our mediation offering

Our mediations support the efficient, well‑prepared resolution of family law cases, and include:

• a pre‑mediation conference with each person and their legal representatives; and
• preparation for, and conduct of, the mediation, including review of the parties' position papers and key documents provided in advance of the mediation.

Mediations can be held in person or remotely. Where available, in‑person mediations may be hosted at our Brisbane, Melbourne and Sydney offices. As a premium offering, mediations hosted at our offices include room hire and catering for all attendees. Mediations may also be held via video conference.

Mediations are conducted on the basis that all parties are legally represented, ensuring discussions are informed, balanced and supported by appropriate legal advice.

What is a private mediation?

Mediation is a confidential, facilitative process in which an independent mediator assists parties, with their legal representatives, to identify issues, explore options and negotiate a resolution. The mediator does not determine outcomes or provide legal advice, but supports constructive, informed discussions aimed at reaching practical, agreed outcomes.

When to mediate?

Mediation can be undertaken at any stage of the family law process. You may choose to mediate before court proceedings commence, or while proceedings are already before the court.

What are the benefits of mediation for family law disputes?

Resolving a dispute through mediation is usually far less expensive and less stressful than court proceedings.

Mediation is designed to facilitate discussion, improve communication, and provide parties with the freedom and flexibility to fully explore their options before reaching a resolution.

Family law mediators are trained to steer parties away from criticism and blame, with a focus on finding outcomes that will provide the most benefit in the future. This is particularly important in parenting cases.

Mediations are structured to be empowering and to give parties greater control over decision making, rather than waiting for a judge to make decisions that may significantly affect their lives and the lives of their children.
