I've divorced from my partner, do I need to have a financial separation?

When a marriage comes to an end, a divorce legally terminates the arrangement. However, a divorce does not sever your financial ties and law in Australia requires you to apply to the court for property orders within 12 months from the date of a divorce. If you are already divorced but have not formally resolved financial matters with your former spouse, we strongly recommend contacting us for specialised family law advice.

My partner and I live together in a property that I own. Should we sign a prenup?

A "prenup", or a financial agreement as they are known in Australia, is a legally binding contract that sets out how your assets - such as the property you reside in - will be divided without the court's intervention if your relationship breaks down in the future.
